1. Object
The following general
terms of business outline the legal relationship between Canford Trade LTD and
its customers. Only these terms are valid, and the terms can also be limited
to special fields of application. The customer cannot alter these terms.
2. Offers, Contracts and Prices
2.1
You must be over 18 years old in order to order products from Erotikexpress.com.
2.2
The order is binding. The contract exists once the ordered goods are sent
or from the confirmation of the order within two weeks of placing the
order.
2.3
The price listed on the day of ordering is binding. Canford Trade LTD may change the prices at any time.
3. Payment
We
currently offer the following methods of payment:
Payment with credit card (Visa, Euro/Mastercard, American Express, Diners
Club)
Bank/Money Transfer (Payment before delivery)
Cash on delivery (only for Germany, Austria and Switzerland)
After
sending the order, the customer will receive a confirmation message on
his or her computer screen. The confirmation will state that the order
has been registered and the invoice will be sent to the customer via e-mail.
4. Delivery
4.1
Deliveries will be made with through the mail or UPS. The ordered goods
will be sent in a plain package with a discreet return address. Generally
deliveries take about one week.
4.2
The shipping costs within Germany, Austria and Switzerland are EUR 5,10.-
(US$ 4,64.-) (When paying with credit card) or EUR 11,30.- (US$ 10,27.-)
when paying Cash On Delivery. Deliveries within other European Union countries
cost EUR 10,20.- (US$ 9,27) (When paying with credit card). Cash on delivery
payment orders outside of Europe are not possible.
5. Transition of Liability
The liability in the
case of problems is that of the customer once the goods have been sent.
This is also the case if Canford Trade LTD
has paid for the shipping.
6. Exchange and Refunds
If the customer does not like the ordered product, or if it is the wrong
size, it can be sent back within 14 days for a full refund. Exceptions
include videos, CD-ROMs and DVDs if they are removed from their plastic
wrappers. Also excluded are damaged items and used hygienic articles.
Sets can only be returned in their entirety. The item must be sent back
within 14 days of receiving it. The item must be properly packed and enough
postage must be used. The customer returns items at his or her own risk.
7. Ownership of Goods
The delivered goods are the property of Canford Trade LTD until the
articles have been paid for in full.
8. Guarantees
8.1
Canford Trade LTD guarantees its products for six months for any problems
that may arise that are covered by the warranty. Products can only be
exchanged for other goods. If there is no improvement with the product,
the customer can choose between a lower price or can elect to end the
contract. Small defects and technical limitations are however and are
not protected by any guarantee. Customers should report any defects within
14 days of receiving the goods.
8.2
Canford Trade LTD claims no responsibility for the marketability or
suitability of the possible uses of its products. We accept no liability
for avoidable or unavoidable damage that might befall the user, such as
market losses, loss or damage to property, death or personal injury. This
is as long as Canford Trade LTD has not shown gross negligence. Other
exclusions to the guarantee may apply.
9. Data Protection
All of your personal
information is handled under the strictest confidentiality. You can find
more information under "Data Protection."
10. Applicable Laws/Written Agreement
10.1
The laws of Britih Virgin Islands, are applicable as far as the terms
of business as well as the legal relationship between Canford Trade LTD and its customers is concerned. Laws of other nations are not applicable.
10.2.
Any changed to the contract must be made in written form.
11. Legal Domicile
The
buying and selling of articles from this website is applicable to the
laws of the British Virgin Islands. Tortola will be used as the legal
domicile. Tortola is the legal domicile for non-shop owners and owners
of small shops, insofar that collection proceedings should become necessary.
